Department of Civil Law at College of Law and Political Science/ AL-Iraqia University organized on Wednesday 13/4/2016 a symposium titled (Legal Procedures to get back assets derived from Corruption).

And the symposium dealt with the phenomenon of corruption that is considered as an old one. Besides, the heavenly books embraced several stories of corruption committed by ancient people and their retributions. 

And the phenomenon became very complicated in a way that impacted the social, political, economic, administrative activities of the society. 

So, eradicating it is not that possible but reducing its effect is possible.

So, the lecturers clarified that corruption has different themes and shapes.

It be could political, Administrative or financial corruption and it might be international or local one. 

Moreover, the power that energizes all the above-mentioned types is called moral corruption. And they referred to the expansion of corruption as a result of many reasons; the most important ones are State weakness and its inability to confront and punish the mistaken employee or corrupt or the absence of strong punishment to confront mistakes and complacency in retribution.

And the lecturers explained that the phenomenon is caused by the appearance of corruption in the higher administration and leadership and the absence of the role model for the rest of administrative structure. 

Therefore, this is to facilitate and encourage the spread and expansion of corruption. Furthermore, corruption has big consequences and negative results on the performance of economy because it threatens development and progress and it is the main factor behind poverty. 

Besides, it impacts local and foreign investments.

And it affects the qualification of infrastructure and productive structure as well. In addition, it has a negative impact on the general expenditure and the state budget.

Besides, the Iraqi legislator found institutions tackling corruption such as Department of Financial Monitoring, Commission of Integrity and General Inspectors while the administrative and financial corruption can be tackled by Iraqi Panel Code No. 111 dated in 1969 Corruption Crimes in the sixth part titled "crimes of job duties" such as bribery, embezzlement and Employees abuse of post crimes

On the top of that, Iraq had endorsed United Nations Anti-Corruption Agreement in 2003 in accordance with the law No.53 dated in 2007. And it is an international agreement of strategic dimensions. 

So, Iraq is obliged from the legal perspective to the law mentioned above and considering it as part of legal system to get back assets derived from corruption.
